Terms and Conditions

TeleoTV, located at TeleoTV, GPO Box 2629, Canberra ACT 2601, Australia(hereinafter referred to as “TeleoTV” or “we”), has developed the application “TeleoTV” which includes an iOS app and Android app. This application can be downloaded at https://teleotv.co.ukand other domains. Before using the services offered by TeleoTV, please carefully review these Terms and Conditions. The TeleoTV application is an electronic programme guide (hereinafter referred to as “EPG”) that provides users with information on UK and Irish TV programmes based on their region. The service is operated from Australia but is designed for UK and Irish TV viewers and is compatible with iPhone, iPad, and Android devices. Scope and application

These Terms and Conditions apply to all services, products, and content created and provided by TeleoTV. They describe the contractual relationship between you and TeleoTV and are intended for both end-customers and companies. End-customers are individuals who enter into legal transactions for purposes that cannot be attributed to their commercial or self-employed professional activities. These terms apply to both registered and unregistered users of TeleoTV products and services.

Eligibility

The TeleoTV service is intended for users aged 18 and over. Users under the age of 18 may only use TeleoTV with the consent and supervision of a parent or legal guardian. By using TeleoTV, you represent that you meet these eligibility requirements. TeleoTV reserves the right to terminate accounts that do not comply with these requirements.

General use of TeleoTV service

The TeleoTV iOS and Android apps can be used with or without a registered TeleoTV account. Creating a TeleoTV account is free and allows for settings and data to be synced between devices. You are solely responsible for maintaining the confidentiality of your password. Do not share your password or allow third parties to access it. If you suspect that your password has been lost or misused, or if you become aware of any unauthorised use of your password, you are obligated to notify us immediately by sending an email to hello@teleotv.co.uk.

TeleoTV does not guarantee the accuracy of the EPG data, images, titles, descriptions, start and end times, or any other EPG-related information. TeleoTV may periodically check and delete accounts and account/device related data if the TeleoTV app has not been used on a user device after a certain period of time.

Data back-up and cloud sync

The data of each registered user is backed up to the cloud and is accessible on all TeleoTV platforms. To ensure the secure transfer of data during synchronisation and backup, we use trusted cloud infrastructure. Sensitive and private data exchanges between the app and its servers occur over an SSL secured communication channel, which is encrypted and protected with digital signatures.

Rules of use

The User shall observe all applicable laws while using the TeleoTV platform. The User shall not enter or disseminate any data or content that violates any law or infringes upon any third-party rights, including but not limited to industrial rights, copyrights, and other intellectual property rights. The User assumes full responsibility for the data and content they provide through the use of TeleoTV. The provider of TeleoTV shall not be held responsible for the accuracy or suitability of any content provided by the User. In the event that the User breaches these obligations, the provider of TeleoTV shall have the right to terminate the User's access to the platform. If the User becomes aware of any illegal or unauthorised use of TeleoTV, they must promptly report such use to the provider via email at hello@teleotv.co.uk.

TV listing data - PA Media

TV listing data displayed within TeleoTV is sourced from PA Media and is provided for personal, non-commercial use only. Users may not commercially exploit, redistribute, sublicence, or otherwise make available any listing data obtained through TeleoTV to any third party.

All listing data is provided on an “as is” basis. Use of this data is at the User's own risk. TeleoTV and PA Media make no warranty, express or implied, regarding the accuracy, completeness, timeliness, or availability of the listing data. Neither TeleoTV nor PA Media shall be liable for any loss or damage arising from the use of, or reliance upon, listing data provided through the service.

Intellectual property

All TeleoTV products and services, as well as specific features and functionality, are the property of TeleoTV and are protected by international copyright and intellectual property laws.

Links to third-party services

TeleoTV's website and mobile apps may contain links to third-party sites or services that are not owned or controlled by TeleoTV. TeleoTV has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. The user is advised to read the terms and conditions and privacy policy of any third-party site visited.

Disclaimer of warranties

The TeleoTV service, including all content, features, and functionality, is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. TeleoTV does not warrant that the service will be uninterrupted, error-free, or free of harmful components. TeleoTV makes no guarantees regarding the accuracy, completeness, or timeliness of any EPG data, programme listings, or other content displayed within the service.

TeleoTV reserves the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. TeleoTV shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

Limitation of liability

To the maximum extent permitted by applicable law, TeleoTV, its operators, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the service. In no event shall TeleoTV's total liability to you for all claims arising from or related to the service exceed the total amount paid by you to TeleoTV in the twelve months preceding the claim. As the core TeleoTV service is free, this amount may be zero.

Nothing in these terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law, including the rights of consumers under UK, Irish, or Australian consumer protection legislation.

Indemnification

You agree to defend, indemnify, and hold harmless TeleoTV, its operators, and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms and Conditions, your misuse of the service, or your violation of any applicable law or the rights of any third party.

Termination of agreement

The user may terminate this agreement and their account at any time by using the Reset App Data option in the app (Profile tab) or by contacting TeleoTV at hello@teleotv.co.uk. The user must then uninstall the TeleoTV app from all devices and their account, along with all related information, will be deleted by the system after a 28-day grace period.

Changes to these Terms and Conditions

TeleoTV reserves the right to modify these Terms and Conditions at any time. The date of the latest revision will be indicated at the bottom of this document. The user is responsible for regularly reviewing these terms to stay informed of any changes.

Governing law

These Terms and Conditions are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory, without prejudice to any rights UK users may have under applicable UK consumer protection law or Irish users may have under applicable Irish consumer protection law.

Your acceptance of these terms

By accessing or using any of TeleoTV's services or products, including, but not limited to, visiting the website, downloading and using the TeleoTV iOS and Android app, or registering as a user, the user agrees to be bound by these Terms and Conditions and the Privacy Policy.
